Guest Terms & Conditions

By checking the acknowledgment box during the booking process, you confirm that you have read, understand, and agree to these Terms & Conditions. You also agree to share these rules with everyone staying at or visiting the property during your reservation and accept responsibility for their compliance.

1. General Responsibility

The person making the reservation (“Guest”) is responsible for the actions of all occupants and visitors during the stay.

Guests agree to:

• Follow all house rules provided for the property.

• Treat the property with care and respect.

• Leave the property in substantially the same condition it was found, excluding normal wear and tear.

• Comply with all local, state, and federal laws.

Failure to comply with these terms may result in immediate termination of the reservation without refund.

2. Maximum Occupancy

Only the number of guests included on the reservation may occupy the property unless prior written approval is provided.

Unauthorized guests may result in immediate cancellation of the reservation without refund.

3. Parties & Events

Parties, events, large gatherings, commercial activities, or unauthorized functions are strictly prohibited.

Violation of this policy may result in immediate removal from the property without refund and additional charges for damages or excessive cleaning.

4. Smoking

Smoking or vaping is prohibited inside the property unless specifically stated otherwise.

A minimum cleaning fee of $500 will be charged for violations.

5. Pets

Pets are only permitted with prior approval.

Unauthorized pets may result in:

• Immediate cancellation of the reservation

• Additional cleaning fees

• Applicable pet fees

• Charges for damages

Approved pets may be subject to additional fees.

6. Parking

Guests must follow all posted parking rules and use only designated parking areas.

Vehicles parked improperly may be towed at the owner’s expense where permitted by law.

7. Property Access

Management reserves the right to enter the property when reasonably necessary for:

• Emergency situations

• Maintenance

• Repairs

• Safety concerns

• Property inspections

Reasonable notice will be provided whenever practical.

8. Damage & Additional Charges

Guests are financially responsible for any damage beyond normal wear and tear caused by themselves or anyone in their party.

Charges may include but are not limited to:

• Property damage

• Missing items

• Excessive cleaning

• Unauthorized pets

• Smoking violations

• Lock replacements

• Excessive trash removal

• Service call fees

Guests authorize payment for legitimate damage claims submitted through the booking platform or payment method on file.

9. Appliances & Amenities

Every reasonable effort is made to ensure all amenities are operational.

Occasionally, unexpected failures may occur involving items such as:

• Air conditioning

• Internet

• Televisions

• Pools

• Hot tubs

• Appliances

• Elevators

• Utilities

Management will make reasonable efforts to resolve issues promptly, but temporary interruptions do not automatically entitle guests to refunds.

10. Lost & Found

Items left behind may be returned upon request.

Guests are responsible for all shipping costs.

Unclaimed property may be discarded or donated after 30 days.

11. Recreational Facilities

Pools, hot tubs, bicycles, beach equipment, docks, grills, recreational equipment, and similar amenities are used entirely at the Guest’s own risk.

Children must be supervised at all times.

Guests assume all risks associated with these activities.

12. Liability Waiver

Guests understand that travel, recreational activities, water activities, stairs, decks, pools, hot tubs, wildlife, weather conditions, and outdoor environments carry inherent risks.

Guests voluntarily assume all risks associated with their stay.

To the fullest extent permitted by law, HoMZ Management LLC, the property owner, and their employees, contractors, and agents shall not be liable for injuries, accidents, loss of personal property, or damages occurring during the reservation except where caused by gross negligence or willful misconduct.

13. Indemnification

Guests agree to indemnify and hold harmless HoMZ Management LLC, the property owner, and their representatives from claims, damages, expenses, attorney’s fees, or liabilities arising from the Guest’s actions or those of anyone permitted onto the property by the Guest.

14. Florida Transient Occupancy

Guests acknowledge that:

• Their stay is temporary.

• This reservation does not establish residency or tenancy.

• This agreement is an innkeeper/guest arrangement governed by Florida law.

• Florida Statutes Chapter 509 applies where applicable.

Guests agree to vacate the property upon checkout.

Any refusal to vacate may be treated as trespass under applicable Florida law.

15. Immediate Removal

Management reserves the right to terminate a reservation without refund if Guests:

• Violate these Terms.

• Violate House Rules.

• Damage the property.

• Disturb neighbors.

• Engage in illegal activity.

• Exceed occupancy limits.

• Refuse to vacate at checkout.

16. Identification

The primary Guest may be required to provide valid government-issued identification matching the reservation before check-in.

17. Force Majeure

HoMZ Management LLC shall not be responsible for circumstances beyond its reasonable control, including but not limited to hurricanes, flooding, severe weather, power outages, utility interruptions, government actions, pandemics, or other force majeure events.

18. Governing Law

These Terms are governed by the laws of the State of Florida.

If any provision is found unenforceable, the remaining provisions shall remain in effect.

Guest Acknowledgement

I certify that:

☐ I am at least 25 years of age (or the minimum booking age required for this reservation).

☐ I accept responsibility for all guests and visitors during the reservation.

☐ I agree to follow all House Rules provided for the specific property.

☐ I understand that violations of these Terms may result in additional charges, cancellation of my reservation, and removal from the property without refund.

☐ I understand that I am financially responsible for any damage caused by myself or anyone in my party.
